A SUBMISSÃO DO CIVIL À CORTE MILITAR BRASILEIRA: análise de constitucionalidade

Resumo

O presente trabalho se dedica a fomentar reflexões e contribuir com a produção de conhecimento, ao promover uma abordagem analítica no que concerne à submissão de jurisdicionado civil a um Tribunal Militar em solo brasileiro. Partir-se-á, neste artigo, da apreciação do estado da arte doutrinário a respeito do tema, bem como da jurisprudência de tribunais superiores, até a análise principiológica, culminando na visão comparada do direito internacional.
O método empregado tem por objetivo emitir posicionamento sobre a conformidade do ordenamento jurídico pátrio com os preceitos constitucionais, penais, processuais
penais e de direitos humanos. Vale dizer: buscam-se elementos para sustentar uma vertente jurídica sobre a (não) submissão de um civil a uma corte militar no
Brasil.

THE SUBMISSION OF THE CIVIL TO THE BRAZILIAN MILITARY COURT: analysis of constitutionality

Abstract: This work dedicates to fostering discussions and contributing to the knowledge production, by promoting an analytical approach regarding the submission of civil claimants to a military court on brazilian soil. Parting will, in this paper, assessing the state of art doctrinary regarding the subject, as well as the superior courts case law, to the principled analysis, ending in the comparative view of the international law.

The method used aims to issue positioning on the conformity of paternal law with constitutional, criminal, criminal procedure and human rights precepts. In other words: elements are searched in order to support a legal slant on the (non) submission of a civilian to a military court in Brazil.
