PRESERVAÇÃO DE LOCAIS DE OCORRÊNCIAS PROCEDIMENTOS DA POLICIA MILITAR

Resumo

ABSTRATO: Depois de se referir brevemente ao inquérito policial, trata da prova técnica , cuja principal finalidade ése ater à análise dos vestígios da infração, ao exame de corpo de delito, ressaltando sua importância e valor. Mostra o papel da PM na obtenção da prova técnica, por ser, geralmente, o policial militar o primeiro a chegar ao local do crime, lavrando o Relatório de Ocorrência, mas perdendo, por falta de orientação, indícios necessários ao inquérito. Lembra que o art. 169 CPP dá competência residual ao policial militar para preservar o local do crime e esclarece o
sentido da norma, mostrando que ao policial militar compete preservar estes locais, evitando que se altere o estado das coisas, exceto quanto à remoção de vítimas em acidentes de trânsito.
Faz sugestões sobre o procedimento do policial militar, no caso de demora da polícia técnica e possibilidade de desaparecimento de indícios ou ainda da necessidade de
remoção deferidos.

PRESERVATION OF LOCATIONS OF MILITARY POLICE PROCEDURES OCCURRENCES


ABSTRACT: After briefly referring to the police investigation, it deals with the technical evidence, whose main purpose is to analyze the traces of the infraction, to examine the body of crime, highlighting its importance and value. It shows the PM's role in obtaining the technical evidence, since the military police are usually the first to arrive at the crime scene, drafting the Occurrence Report, but losing, for lack of guidance, necessary evidence for the investigation. Remember that art. 169 CPP gives residual powers to the military police to preserve the crime scene and clarifies the
sense of the norm, showing that it is the duty of the military police to preserve these places, avoiding to change the state of affairs, except for the removal of victims in traffic accidents.
It makes suggestions on the procedure of the military police, in case of delay of the technical police and possibility of disappearance of indications or of the necessity of
deferred removal.
