A RESPONSABILIDADE PENAL DO SNIPER POLICIAL MILITAR EM OCORRÊNCIAS DE ALTA COMPLEXIDADE NO ESTADO DE MINAS GERAIS

Resumo

Este estudo teve como objetivo identificar, dentro das normas jurídicas nacionais, em qual
excludente, no caso de ocorrências com reféns localizados, o emprego do tiro letal do sniper policial militar encontra-se amparado. Em face do estudo proposto, será necessário o exame da legislação pátria para a busca de argumentos jurídicos capazes de imputar responsabilidade penal, no que tange ao disparo letal, e de comparar as normas jurídicas brasileiras, a fim de
se identificar paradigmas jurídicos que possam servir de respaldo para a construção da melhor resposta ao problema. No presente estudo, buscam-se dentro da doutrina e legislação vigentes os pontos comuns e divergentes, bem como uma comparação e estudo direto acerca da responsabilidade do sniper. Após seguir os passos narrados, conclui-se que o sniper, para efetuar
o tiro de precisão com neutralização ou morte do agente, não possui autonomia de ação. Ele depende da ordem do seu superior hierárquico para agir, caso contrário será responsabilizado pelo crime de homicídio. Dessa forma, sua atuação encontra amparo legal na legítima defesa
de terceiros e, por outra excludente, na inexigibilidade de conduta diversa, pois recebe ordem para efetuar o disparo letal pela sua estrita obediência hierárquica.

This study aimed to identify, within the of national legal rules, in which excluding, in the case of

After following the steps narrated, conclude that the sniper to make precision shooting with neutralizing agent’s death, has no autonomy of action. Depending
on the order of his superior to act, otherwise it will be responsible for the crime of murder. Thus is performance is legal support for the legitimate defense of third parties and other exclusionary enforceability of the diverse conduct, because it is commanded to make the letal shot, for their obedience hierarchical.
