Resumo

ABSTRATO: O objetivo deste trabalho é aliar o emprego de algemas no Estado Democrático de Direito à proteção jurídica dada à dignidade da pessoa humana, buscando, ainda, conhecer os problemas advindos da inércia legislativa ante a determinação trazida pela Lei de Execução Penal, desde 1984, no sentido de que o emprego das algemas fosse regulamentado.

THE EMPLOYMENT OF ALGEMAS AND THE RESPECT OF THE DIGNITY OF THE HUMAN PERSON.

ABSTRACT: The objective of this work is to combine the use of handcuffs in the Democratic State of Right to legal protection given to the dignity of the human person, also seeking to know the problems arising from legislative inertia before the determination brought by the Criminal Enforcement Law since 1984 , in the sense that the use of handcuffs should be regulated.
