LIMITES E EXTENSÃO DO PODER DE POLÍCIA NA PROTEÇÃO DO MEIO AMBIENTE À LUZ DO DIREITO CONSTITUCIONAL ADMINISTRATIVO

Resumo

Abstrato: O artigo aborda questões acerca do dever fiscalizatório da Administração Pública, inerente aos limites do poder de polícia na proteção do meio ambiente, e dos contornos do exercício da polícia administrativa ambiental, com relevância às controvérsias sobre a idéia do domínio do ciclo completo de polícia, em matéria de meio ambiente, pela Polícia Militar. A importância e atualidade do tema derivam, sobremodo, em função de três aspectos: o primeiro, por ser a Administração Pública, responsável pelo exercício da polícia administrativa ambiental, na atual política promovida pelo Estado; o segundo, a necessidade de preservar e promover o meio ambiente; e, o terceiro, que traz consigo uma dificuldade intrínseca, é o fato de que o conteúdo e o exercício do poder de polícia pelos órgãos administrativos ainda não receberam a devida atenção da doutrina consubstanciada no Direito Constitucional Administrativo.

LIMITS AND EXTENSION OF POLICE POWER IN PROTECTING THE ENVIRONMENT IN THE LIGHT OF ADMINISTRATIVE CONSTITUTIONAL LAW

Abstract: This article deals with questions about the Public Administration's audit duty, inherent to the limits of the police power in environmental protection, and the contours of the environmental administrative police exercise, with relevance to the controversy over the idea of the complete cycle of in the field of the environment, by the Military Police. The importance and timeliness of the theme derive, in particular, from three aspects: the first, being the Public Administration, responsible for the exercise of environmental administrative police, in the current policy promoted by the State; the second, the need to preserve and promote the environment; and the third, which brings with it an intrinsic difficulty, is the fact that the content and exercise of police power by the administrative organs have not yet received due attention from the doctrine embodied in Constitutional Administrative Law.
