PAPEL CONSTITUCIONAL DA UNIÃO NA SEGURANÇA PÚBLICA: RETROSPECTIVA E ANÁLISE

Resumo

ABSTRATO: Este artigo tem por objetivo apresentar um retrospecto histórico do  papel do Governo Federal na segurança pública desde a Carta Imperial até os dias
atuais. Historicamente, a segurança pública sempre foi um tema desafiador e relevante, tanto que já aparece na primeira Constituição do Império, logo após o processo de Independência, em 1824, quando estabelecia que era atribuição do Imperador prover a segurança interna. Vale ressaltar que em todas as Cartas, em especial na atual, houve valorização da segurança, inserindo como direito e garantia fundamentais, como atribuição do Estado brasileiro o dever de proporcionála. Ao longo das Constituições, a União se fez presente na segurança pública, culminando com um papel mais contundente na atual Constituição Federal. Além do que prevê a Constituição de 1988, levantou-se na legislação infraconstitucional a estrutura da União para fazer face à segurança pública. Ao final, propõem se mudanças tanto no aspecto de marco legal quanto na estrutura organizacional do Governo Federal para a gestão da segurança pública.

THE CONSTITUTIONAL ROLE OF THE UNION IN PUBLIC SECURITY: RETROSPECTIVE AND ANALYSIS

ABSTRACT: This article aims to present a historical retrospective of the role of the Federal Government in public security from the Imperial Charter to the days
current. Historically, public security has always been a challenging and relevant subject, so much so that it already appears in the first Constitution of the Empire, shortly after the Independence process, in 1824, when it was established that it was the Emperor's assignment to provide internal security. It is worth emphasizing that in all the Letters, especially in the present one, there was valorization of security, inserting as fundamental right and guarantee, as attribution of the Brazilian State the duty to provide it. Throughout the Constitutions, the Union was present in public security, culminating with a stronger role in the current Federal Constitution. In addition to the provisions of the 1988 Constitution, the structure of the Union to deal with public security was raised in infra-constitutional legislation. In the end, they propose changes in both the legal framework aspect and the Federal Government's organizational structure for the management of public security.
